SCMP: Transgender rights: top Hong Kong court says in landmark ruling government breached rights of 2 trans men by preventing them from changing ID cards

Our firm was recently interviewed by the South China Morning Post SCMP to comment on the recent CFA case of Q & Tse Henry Edward v Commissioner of Registration regarding the policy requiring transgender persons to undergo full sexual reassignment surgery (SRS) as a necessary condition for altering the gender markers on their HKID cards.

As a firm experienced in litigating cases to advance the rights of the transgender community, our Firm welcomes the judgment, particularly when such “policies have an effect on people’s lives – this is not in doubt. And in the case of Q and Henry Tse, we are happy to see the court’s recognition of the disproportionate damage done to vulnerable transgender people in the name of administrative convenience.”

We urge the government to take the necessary actions to rectify their policies to reflect this judgement as soon as possible.
