The HKSAR Government has recently unveiled the consultation document concerning plans to enact domestic legislation under Article 23 of the Basic Law, which targets acts of treason, insurrection, sabotage, foreign interference, theft of state secrets and espionage.
Our Principal Mr. Mark Daly was interviewed by South China Morning Post (SCMP) to comment on the Government’s plan, where it was proposed that the authorities would be allowed to extend the detention period of arrestees in national security cases and delaying their right to seek legal representation.
On the above proposal, Mr. Daly noted that “banning consultation with lawyers and extending detention would raise great concerns about further deviation from important human rights or legal safeguards“, and stressed the importance of legal representation in avoiding any abuse.
