In response to the Court of Final Appeal’s decision that it was unconstitutional for the government to require a person to complete full gender reassignment surgery before the “sex entry” on their ID card could be changed, the Director of Immigration has published its new policy on 3 April 2024, over a year after the judgment was released.
Our Principal Mr Mark Daly was interviewed by AFP to comment on the Director’s recent policy. Mr. Daly believes that the policy would be open to further challenge, as it demands “an invasive procedure that is not necessarily medically required by many of the transgender community”. Daly & Associates is a firm experienced in judicial reviews against governmental policies in protection of the rights of the LGBT+ community.
